Understanding Murder Under Texas Law

Texas does not classify homicides by "degrees." Instead, Texas Penal Code Chapter 19 differentiates these high-stakes allegations based on your alleged intent, who the victim was, and the specific circumstances surrounding the incident.

Murder 

A person can be charged with murder if the state claims they intentionally or knowingly caused the death of an individual, or intended to cause serious bodily injury and committed an act clearly dangerous to human life that resulted in death. 

It also includes felony murder, where a death occurs accidentally while a person is committing separate serious crimes. 

The penalties: Murder is classified as a first-degree felony, carrying a punishment range of five to 99 years, or life in prison, alongside fines of up to $10,000. 

The "sudden passion" mitigation: If the defense can prove during the sentencing phase that you were under the immediate influence of sudden passion arising from an adequate cause (such as intense terror or rage brought on by provocation), the classification drops to a second-degree felony, reducing the maximum sentence to 20 years.
